1. Scope of application
These general terms and conditions apply to all contracts concluded with us, jobotex. Deviating conditions of the customer are hereby rejected and declared by us as non-binding, even if we carry out the delivery without separate reservation.
2. Offers and services
All offers and agreements are subject to change and non-binding until confirmed by us in writing.
3. Prices (domestic, EU, Switzerland)
Unless expressly confirmed otherwise by us, prices are ex works plus value added tax. Deliveries within the EU do not include VAT, provided that the buyer has a valid VAT identification number. Deliveries to Switzerland do not include VAT.
4. Delivery
All deliveries are made at the buyer's risk and expense. The buyer bears the shipping costs.
5. Payment
The invoice is issued on the day the goods are made available. As of the 1st day after the net due date, default occurs in accordance with §286 II No. 1 BGB (German Civil Code).
We are not obliged to make any further deliveries prior to complete payment and may withdraw from the contract if the purchaser is in default of payment for outstanding deliveries. If payment is made after the due date, interest of 8% above the respective base interest rate of the Deutsche Bundesbank will be charged.
Payment can be made by bank transfer or via Paypal. There is no cash discount for payments via Paypal. For new customers the payment of the first order is to be made against prepayment. Prepayment is also required for shipments abroad.
Please note that the minimum order value is 70,- € net.
6. Notice of defects
Complaints should be reported to us in writing and within eight days after receipt of the goods. After the delivered goods have been cut to size or otherwise processed, any complaint of obvious defects is excluded.
7. Retention of title
The goods remain our property until full payment of all claims arising from the delivery of goods from the entire business relationship, including ancillary claims and claims for damages.
In the event of combination, mixing or processing with goods not belonging to us, we shall acquire co-ownership of the new item in proportion to the invoiced value of its reserved goods to the total value.
8. Warranty and liability
The warranty rights of the customer presuppose that he has properly fulfilled the owed inspection and return obligations according to §377 HGB (German Commercial Code).
If there is a defect in the delivery item for which we are responsible or if a warranted characteristic is missing, we are entitled and obliged, at our discretion, to remedy the defect free of charge or to make a replacement delivery. The prerequisite is that the goods complained about are made available to us for inspection.
Unless otherwise agreed, further claims of the customer - on whatever legal grounds - are excluded. We are therefore not liable for damage that has not occurred to the delivery item itself.
Any further liability for damages other than provided for in the warranty and liability paragraph is excluded regardless of the legal nature of the asserted claim.
Should one or more provisions of these GTCs be invalid, this shall not affect the validity of the remaining provisions. A replacement clause shall then apply which comes as close as possible in legal and economic terms to the invalid provision.
9. Copyright
The jobotex and jobolino products are protected by copyright. It is strictly forbidden to copy, duplicate or distribute contents, texts, graphics or pictures, even in extracts, without the express consent of jobotex. The offence is punishable by law and will be punished accordingly.
10. Applicable law
The laws of the Federal Republic of Germany shall apply to all legal relationships between the parties to the exclusion of the laws governing the international sale of movable goods. Place of performance and jurisdiction is Bad Homburg.
